Welcome to Zoomies on Wheels. These Terms & Conditions (“Terms”) govern your use of our website at zoomiesonwheels.co and your purchase or use of any service we provide. By booking a session, purchasing a membership, or otherwise using our services, you agree to these Terms. If you don’t agree, please don’t use our services.
1. Who We Are
Zoomies on Wheels is a mobile dog fitness service based in Twin Falls, Idaho, serving Twin Falls and the surrounding Magic Valley area. We bring professional dog treadmill equipment, supervised exercise, and structured fitness programs to clients’ homes. You can reach us at zoomiesonwheels@outlook.com.
2. Booking & Scheduling
- Sessions are booked through our website, by phone, or directly with our team.
- Service availability is subject to our published schedule, geographic service area, weather, and operational constraints. We reserve the right to refuse, postpone, or cancel any appointment at our discretion — including for safety, weather, or behavioral reasons.
- You agree to provide accurate contact, dog, and address information at the time of booking. We rely on this information to deliver service safely.
3. Memberships, Pricing & Payment
- Our pricing tiers (initial visit, single session, and weekly memberships) are published on our website and may change from time to time. Active memberships honor the price in effect at the time of signup until your next renewal cycle.
- Memberships renew automatically on the schedule you selected (weekly or monthly), and you authorize us to charge your payment method on file for each renewal.
- Payments are processed by Stripe. We do not store full card numbers on our servers.
- You can cancel a recurring membership at any time from your account dashboard or by contacting us. Cancellation stops future renewals; we do not pro-rate or refund the current billing period unless required by law.
4. Cancellations & Rescheduling
- Please cancel or reschedule at least 24 hours before your appointment. Cancellations inside the 24-hour window may be billed at the full session rate at our discretion, since the time and trailer were reserved for your dog.
- We cancel for severe weather, mechanical issues, or staff unavailability without charge. We’ll work with you to reschedule the missed session.
- No-shows (we arrive on time and you’re not available) are billed at the full session rate.
5. Refunds
Initial visits and single sessions are generally non-refundable once completed. Membership payments are non-refundable for the current cycle once charged, except in cases of clear billing error or where required by Idaho law. If you believe you’ve been charged in error, contact us within 30 days and we’ll work with you in good faith.
6. Health Requirements & Waiver
Treadmill exercise is intense, structured activity. Before your dog’s first session you’ll be asked to acknowledge our Waiver & Consent Form, which covers health disclosure, assumption of risk, emergency authorization, and behavior representations. By booking with us you agree that:
- Your dog is in good general health and fit for moderate-to-vigorous exercise.
- You will disclose any known medical, orthopedic, behavioral, or aggression issues prior to service.
- You authorize us to seek emergency veterinary care at your expense if you cannot be reached. We will make every reasonable effort to contact you first.
We reserve the right to refuse or terminate a session if a dog is deemed unsafe, in distress, or unfit for the activity. Session fees in such cases are non-refundable.
7. Assumption of Risk & Limitation of Liability
Canine exercise involves inherent risks, including injury, illness, behavioral stress, and in rare cases death. By participating, you voluntarily assume all such risks. To the fullest extent permitted by Idaho law, Zoomies on Wheels and its owners, employees, contractors, and affiliates are not liable for any direct, indirect, incidental, consequential, or special damages arising out of your dog’s participation, our services, or our website — except in cases of gross negligence or willful misconduct.
Our total liability for any claim is limited to the amount you paid us for the service giving rise to the claim. This limitation applies whether the claim is in contract, tort, statute, or any other legal theory.
8. Photo & Video
We may take photographs or short video clips of your dog during sessions for member portal recaps, social media, marketing, and our website. By using our services you grant us permission to use this media. If you do not want photos or videos of your dog used publicly, simply email us at zoomiesonwheels@outlook.com and we’ll honor that request going forward. We never identify dogs by owner name without separate consent.
9. Your Conduct
You agree not to:
- Misrepresent your dog’s health, behavior, or vaccination status.
- Use our services for any unlawful purpose.
- Attempt to interfere with, reverse-engineer, or harm our website, booking system, or trailer equipment.
- Resell our services without prior written consent.
10. Intellectual Property
All content on this website — text, images, video, branding, the “Zoomies on Wheels” name and logo — is owned by Zoomies on Wheels or used under license. You may not reproduce or republish it without permission. You may share or link to individual pages from a personal social account without prior consent.
11. Third-Party Services
We use third-party providers to deliver this service, including (without limitation) Stripe for payment, Resend for email, and Google Analytics for usage measurement. Their use of your information is governed by their own terms and our Privacy Policy.
12. Changes to These Terms
We may update these Terms from time to time. The current version is always posted at this URL with the “last updated” date above. Material changes will be noted prominently. Your continued use of our services after a change indicates acceptance of the updated Terms.
13. Governing Law & Disputes
These Terms are governed by the laws of the State of Idaho, without regard to its conflict of laws principles. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Twin Falls County, Idaho, and you consent to that venue.
Before filing any formal action, you agree to make a good-faith attempt to resolve the dispute by contacting us at zoomiesonwheels@outlook.com.
14. Severability
If any portion of these Terms is found unenforceable, the remaining portions stay in full force. Our failure to enforce any provision is not a waiver of our right to enforce it later.
